VII National Annual Moot Court on Arbitration of Corporate Disputes named after Professor Mozolin
The plot of the 2023 Mozolin Corporate Arbitration Moot Court revolved around issues of dispute resolution through adjudication, multi-tiered arbitration agreements, the independence and impartiality of the expert, and the modification of the agreement on the distribution of shares in the newly formed company.
More than 60 teams from various regions of Russia participated in the competition, including teams from Moscow, St. Petersburg, Irkutsk, Yekaterinburg, Tomsk, Tver, Veliky Novgorod, Perm, and Murom. Additionally, for the first time, students from Belarus took part in the competition. In total, the competition brought together over 300 students and 160 arbitrators.
As in the previous year, in 2023, two online pre-moots and two face-to-face pre-moots were held as part of the competition, in collaboration with the Ural Branch of the Private Law Research Centre (Yekaterinburg) and HSE University (Moscow). These events allowed participants to delve deeper into the competition’s plot and better prepare for the qualifying and final rounds.
Results
Following the rounds held on December 2nd and 3rd, the prize-winning teams were announced as follows:
1st place – Team No. 155, HSE University, Moscow State University (MSU) (team members: Danila Eroshin, Nika Veselova, Danil Zarnitsyn, Zaira Ravaeva, Maria Miroshkina, Anna Stepanova, Evgeniya Aleshina, team coaches: Maxim Pshenichnikov, Anastasia Simonova);
2nd place – Team No. 107, Moscow State University (MSU) (team members: Alexander Lukin, Rostislav Bevzenko, Oleg Ovshinov, Boris Grigoryan, Anastasia Rudenya, Ivan Ryakhovsky, team coach: Alexander Guna);
3rd place – Team No. 554, HSE University, Moscow State University (MSU) (team members: Irina Ivanova, Rashit Rakhmatullin, Mark Redya, Varvara Ivanova, Ilyas Galimkhanov, Polina Novoseltseva, team coach: Tatiana Polevshchikova).
Maria Lukoyanova (Team No. 119, MSU) was ranked as the Best Speaker of the Competition, and Sergei Saveliev (partner at Saveliev, Batanov & Partners) was selected as the Best Arbitrator.
The team with the highest scores for procedural documents was Team No. 102, Higher School of Economics (HSE) (team members: Dzhisan Sangadzhi-Goryaev, Elizaveta Savoskina, Maria Koksharova, Olesia Nikolenko, Adelina Safiullina, team coaches: Artem Asoyan, Anton Mukhametshin).
Conference
Conference dedicated to ADR, corporate conflicts, corporate law and M&A preceded the opening of the oral rounds of the Mozolin Corporate Arbitration Moot Court. The Conference consisted of two discussion sessions moderated by Yuri Babichev, partner at ALUMNI Partners, and Roman Zaitsev, partner at Nextons. The Conference speakers included:
● Daniil Petrukh, Senior Legal Counsel at SIBUR. Daniil shed light on the practical aspects of developing multi-tiered dispute resolution models.
● Natalia Soldatenkova, Lawyer at EPAM Law Offices. Natalia explored the prospects and challenges of adjudication for various categories of disputes.
● Valerian Mamageishvili, Senior Lawyer at Better Chance. Valerian presented the issue of mandatory, imperative, and dispositive norms of corporate law when establishing a legal entity in the Russian Federation.
● Gleb Bazurin, Senior Lawyer at VK Partners. Gleb addressed the admissibility and impact of choosing foreign law in documents prepared during the establishment of a legal entity.
● Olga Boltenko, Partner at Fangda Partners. Olga discussed conflicts of interest from the perspective of applicable law and regulatory sources.
